ARTEMEST USA, Inc. (“Artemest”,“Vendor”, “we”, “us”, “our”) respects the privacy of its consumers (“customers”, “users”, “you”, “your”). This Privacy Policy applies to the personal information we obtain through your transactions and interactions with the Vendor, including through your use of Vendor’s website “artemest.com” (hereinafter referred to as “the Site”), mobile applications, social media pages, through surveys, and marketing. A. Vendor uses your information to perform under a contract with you or to take steps, at your request, prior to entering into a contract, such as:

  • Transact with you and provide various products and services to you;
  • Process and fulfill orders in connection with our products and services;
  • Provide client and customer support services;
  • Create and manage your account with Vendor;

B. Vendor also uses your information for legitimate business interests, including:

  • Should Vendor, or substantially all of its assets, be acquired by an unrelated third party through sale, merger, or any other reason, your personal information may be one of the transferred assets.

4. How long Personal Information is Retained

To the extent permitted by applicable law, we typically retain personal information obtained about you for as long as needed for the purposes we obtained it, which generally means we will keep your personal information for the duration of our relationship or as long as you keep your account open with us. Alternatively, we retain your personal information taking into account mandatory applicable laws, including applicable statute of limitation periods.

5. Your Controls

  • You may update certain account profile information, such as your name, contact information, and marketing preferences, by logging into your account on the Site.
  • By providing Vendor with your email address, you are giving us permission to send you electronic communications. You may opt out of receiving our emails by following the unsubscribe instructions at the bottom of every correspondence we send. We may still contact you for transactional purposes, including customer service (questions or information regarding your order), service or reminder notices, and product recall notifications.
  • Many web browsers are set to accept cookies and similar tracking technologies by default. If you prefer, you can set your browser to delete or reject these technologies. If you choose to delete or reject these technologies, this can affect certain features of the Site.
  • Although certain web browsers allow you to send Do Not Track (“DNT”) signals to websites you visit, informing those sites you do not want your online activities to be tracked, the Site is not designed to respond to all types of DNT signals or similar mechanisms from browsers, and there is no common, industry-accepted standard for doing so.

Vendor has implemented administrative, technical, and physical safeguards to protect your personal information against accidental, unauthorized, or unlawful access, destruction, loss, alteration, disclosure and/or use. Nevertheless, no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its security and will not assume liability for improper and unauthorized security breaches. We may change our hosting, storage and security procedures at any time without notice to you.

7. Children’s Privacy

The Site is intended for a general adult audience and is not directed at children under thirteen-years-old (or minors in general, as applicable under relevant law). Vendor does not knowingly solicit or collect personal information (as defined by the U.S. Children’s Privacy Protection Act, or COPPA) in a manner not permitted by COPPA. If you are a parent or guardian and you believe we have collected information pertaining to your child in a manner not permitted by law, contact us at concierge@artemest.com, and we will remove the data from our servers to the extent required by applicable laws.

8. Changes to this Privacy Policy

Vendor reserves the right to revise and/or update this Privacy Policy at any time, without prior notice to you. The revised/updated Privacy Policy will be effective upon posting. After we post any changes to the Privacy Policy, your continued use of the Site is subject to the updated Privacy Policy. If you object to any change, you can stop using the Site. Please check the Privacy Policy periodically to keep informed of any changes. The date the Privacy Policy was last updated will appear at the bottom of the last page. In the event that any provision of this Privacy Policy is found invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.
